Terms of Service

By installing, accessing, or using the Tempo Kit browser extension (“the Extension”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not install or use the Extension.

Tempo Kit is a browser extension for supported Chromium-based browsers that provides musicians with practice tools including a metronome, chromatic tuner, timer, stopwatch, mini control drawers, and video practice tools (speed control, pitch transposition, A-B loops, and BPM detection) for YouTube, Bilibili, and other video/audio pages you choose to connect. The Extension also includes a local file player page for practicing with your own audio or video files and a practice library for saving presets and organizing practice routines. On some pages, pitch shifting works by processing the tab's audio output on your device in real time.

Video practice features modify playback locally in your browser in real time. Tempo Kit does not download, copy, cache, store, or redistribute audio or video content from any website.

Tempo Kit depends on Chromium extension APIs, browser behavior, and third-party websites such as YouTube, Bilibili, and any other site you connect. Those platforms may change their code, policies, access rules, media players, or technical restrictions at any time. We do not guarantee that Tempo Kit will remain compatible with any particular website, browser version, operating system, video page, Shorts page, media player, or device setup.

Some features may stop working, require reconnecting, or become unavailable if a third-party platform blocks integrations, changes its player, limits access, or makes a workflow technically impossible. On some sites — particularly streaming services that protect their media — only a subset of features may work, and individual controls (such as speed or loops) may behave inconsistently or be unavailable.

We may modify, suspend, replace, or discontinue parts of Tempo Kit when needed to fix bugs, improve security, comply with legal or platform requirements, or respond to browser or third-party platform changes.

You must be at least 13 years old to use Tempo Kit. If you are under the age of majority where you live, you may use Tempo Kit only with permission from a parent or legal guardian.

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Extension for personal practice or internal professional practice use on devices that you own or control, subject to these Terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the Extension
• Reverse engineer or attempt to extract the source code except where applicable law allows it despite this restriction
• Use the Extension for any unlawful purpose
• Remove or alter any proprietary notices or labels

The Extension offers a free tier with the metronome, chromatic tuner, timer, stopwatch, and metronome mini controls. Pro plans add video practice controls (YouTube, Bilibili, connected sites, and the local file player), a video mini control drawer, a larger device-local practice library with 300+ saved presets, folders, saved video practice profiles, and future Pro tools.

Pro features are available through subscription or one-time purchase, processed via ExtensionPay (which uses Stripe). By purchasing a Pro plan, you also agree to ExtensionPay's and Stripe's terms of service.

Pro access is verified through ExtensionPay, not through your browser profile or Google account. Browser sync may synchronize small settings when enabled, but the practice library is stored locally on each device and browser sync is not proof of purchase.

A lifetime purchase means access to eligible Pro features for the lifetime of the Tempo Kit product or service. It is not a guarantee that any specific feature, website integration, browser API, third-party platform, or technical method will remain available forever.

Pro subscriptions are billed on a recurring basis (monthly or yearly) unless cancelled. Lifetime purchases are a one-time payment. All payment processing is handled by ExtensionPay and Stripe — we do not store or process payment information directly.

Prices may be subject to change with reasonable notice. Any price changes will not affect existing subscription periods. Prices may exclude taxes, fees, or currency-conversion charges that may be collected or applied by payment processors, banks, app stores, or other providers.

Tempo Kit/Crescendo Companion is the seller/operator and support contact for Tempo Kit Pro features, not Google, YouTube, or the Chrome Web Store. Contact crescendocompanion@gmail.com for billing support, refund requests, and Pro access help.

You may cancel your subscription at any time. Cancellation stops future renewals, but you will keep access to paid features until the end of your current billing period.

We generally do not provide prorated refunds for unused subscription time. Lifetime purchases are generally final once payment is completed. We may issue refunds for duplicate charges, billing errors, or serious technical problems at our discretion.

Except where required by applicable law, refunds are not provided solely because a third-party website, browser, device, operating system, or media player changes, blocks, restricts, or removes the technical capability needed for Tempo Kit to work.

The Extension, including its design, code, features, graphics, and documentation, is owned by Tempo Kit/Crescendo Companion and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Extension.

The Extension uses third-party libraries that remain subject to their own licenses. For details, see our Licenses.

THE EXTENSION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Extension will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy of BPM detection, pitch detection, or any other measurement provided by the Extension.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TEMPO KIT, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Extension
• Any unauthorized access to or alteration of your data
• Any bugs, viruses, or other harmful code transmitted through the Extension
• Any interruption, removal, restriction, or cessation of the Extension's functionality

You agree to indemnify, defend, and hold harmless Tempo Kit/Crescendo Companion and its developers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Extension; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third-party right or third-party terms of service, including the terms of any website or streaming service you choose to use the Extension with.

You are responsible for using Tempo Kit lawfully and responsibly. You may not use Tempo Kit to infringe copyrights, bypass access controls, evade technical restrictions, download or redistribute third-party content, violate third-party terms, interfere with any website or service, or harm the security or operation of Tempo Kit or another service.

Tempo Kit is designed for use with supported video pages and your own local files. It is not designed for, and must not be used to record, rip, download, or bypass content protections on, DRM-protected streaming services (for example, subscription music or video services). Whether a particular service permits playback-modification tools is governed by that service's own terms; you are solely responsible for confirming that your use is permitted, and you use the Extension with any third-party service at your own risk.

Tempo Kit is not affiliated with, endorsed by, or sponsored by YouTube, Google, Bilibili, or any other third-party service whose pages may be accessed through the Extension. All product names, logos, and trademarks are the property of their respective owners and are referenced only to describe compatibility.

Where Tempo Kit modifies playback, it acts as a general-purpose, on-device audio tool — like a volume control or equalizer. It changes how the sound of a page you connect plays back on your own device, in real time, by processing the audio your browser is already playing to you. It does not record, save, download, redistribute, or provide access to any content, and it does not decrypt, circumvent, or otherwise bypass any content protection or access control.

You decide which sites and services to use the Extension with, and you are the one changing playback — so your use of any third-party service is your responsibility, on the terms set out in Section 13 (Acceptable Use) above.

The local file player lets you practice with audio or video files from your own device. You are responsible for ensuring you own or have the necessary rights to any file you open with Tempo Kit.

Files you open are processed entirely on your device. They are never uploaded to us or to any third party, never written to extension storage, and are released automatically when you load a different file, eject the file, or close the player tab. Tempo Kit retains no copy of your files.

Your use of Tempo Kit is also covered by our Privacy Policy, which explains local extension storage, microphone processing, tab audio processing, payment-provider handling, support emails, and data deletion options.

We reserve the right to suspend or terminate your access to the Extension, including Pro features, at our sole discretion, for any reason, including but not limited to breach of these Terms. Upon termination:

• Your license to use the Extension is immediately revoked
• You must uninstall the Extension
• Provisions that by their nature should survive termination (including warranty disclaimers, limitation of liability, indemnification, and governing law) will survive

We reserve the right to modify these Terms at any time. Changes will be reflected by updating the “Last updated” date at the top of this page. Material changes will be communicated through the Extension or our website. Your continued use of the Extension after any modification constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. In the event of any dispute, controversy, or claim, you agree to first contact us and attempt to resolve the issue through negotiation before initiating any formal legal action. If we are unable to resolve the dispute, the matter may be submitted to a court of competent jurisdiction.
